did you sign a buyer brokers agreement with first agent? if so then yes you owe them a fee
why did you call another agent?

You are probably going to have to pay a commission. Did you make an offer on the condo thru the first agent?

Read the contract you signed with the first agent.

If you signed a buyer’s agency agreement with the first agent, then yes, you owe a commission, even if you did not use that agent in your transaction. If you did not have a written agreement with the first agent, or if you did but it had expired, then no, you do not owe a commission.

you may need to pay her a commission b/c she was the one who originally showed you the condo. check with your Buyer’s Agent agreement to see what the waiting period is.

just for future reference, I’m a big fan of using a realtor you trust and get along with. It’s fine if you didn’t like the first realtor and wanted to change, but she needs to get in on the action for doing work for you and finding the house you eventually purchased (if you had told your 2nd realtor, s/he may have been able to give the 1st agent a referral fee or something). Buyer’s agents work for you (the buyer) for FREE until the sale is completed. then they get compensated by the listing agent for helping them sell the house.

Why didn’t you purchase it with the original agent? She spent her time and energy, her only assets, to help you out, and you rewarded her by buying through someone else?

It may not be illegal but it’s definitely unethical in my book.

If you signed a contract with the first agent you may still be required to pay her commission, usually these contracts are for 6 months. Review your buyer agent agreement and see what the guidelines are. I think she has every right to be upset and want her commission.

have a lawyer read the contract you signed with the first agent. Depending upon what the contract says, you may or may not need to pay the commission.
